The Incident
On April 15, 2024, a pedestrian, identified as 46-year-old Frank William Seaman, was fatally struck by a vehicle at West Fourth Avenue and Polk Street in Eugene.
Charges and Plea
Austin, now 20, has been charged with failing to perform the duties of a driver to an injured person, a Class B felony in Oregon. He has pleaded not guilty to the charge.
Defense Arguments and Denied Motion
Austin's attorney filed a motion to dismiss the charge, arguing, among other things, that police testimony before a grand jury inaccurately implied he might have been under the influence
Trial Date Set
After a postponement from an earlier date, Austin's trial is now scheduled to begin on August 14, 2025, in Lane County Circuit Court.
